1. compliance with the General Plan of Bratislava, the Capital of the SR for 2007, as amended (ÚPN):
The filing shall contain the assessment of compliance with the valid regulation under the ÚPN, in particular in terms of the intensity of use of the area and the functional use of the area. It is necessary to distinguish whether the construction is in development areas or in stabilised areas of the city.
Indicate the data on the plan’s compliance with the general plan documentation under Section 3 (4) (a) of Regulation No. 453/2000 Coll., including, in particular, the following data on the proposed construction, the area concerned, and the functional area affected:
- in development areas:
- assessment of compliance with the regulation on intensity of use of the development area (IPP, IZP, KZ) of the surface of the area concerned (part of the functional area or construction site) and providing evidence of compliance with the data in the respective regulation charts of the mandatory part of the ÚPN;
- assessment of compliance of the investment plan with the regulation on functional use of areas; in the event of a limited share of a certain function, it is necessary to assess the compliance of the whole functional area;
- in stabilised areas for areas of undeveloped land:
- assessment of compliance with regulation on intensity of use of the stabilised area (IPP, IZP, KZ) of the whole functional area, excluding the plot of land of the investment plan – current situation;
- assessment of compliance with regulation on intensity of use of the stabilised area (IPP, IZP, KZ) of the whole functional area, including the plot of land of the investment plan – future situation;
- assessment of compliance with regulation on intensity of use (IPP, IZP, KZ) of the surface of the areas of interest (part of the functional area or construction site) – future situation;
- assessment of compliance of the investment plan with the regulation on functional use of areas with regulation of functional use of the areas; in the event of limited share of residential surface (functional area codes 201, 202, and 501), it is necessary to assess the compliance of the whole functional area;
- in stabilised areas for (partially) built-up area (also in the case of proposed rehabilitation of current buildings):
- assessment of compliance with regulation on intensity of use of the stabilised area (IPP, IZP, KZ) of the whole functional area, including the plot of land of the investment plan – current situation;
- assessment of compliance with regulation on intensity of use of the stabilised area (IPP, IZP, KZ) of the whole functional area, including the plot of land of the investment plan – future situation;
- assessment of compliance with regulation on intensity of use (IPP, IZP, KZ) of the surface of the areas of interest (part of the functional area or construction site) – current situation;
- assessment of compliance with regulation on intensity of use (IPP, IZP, KZ) of the surface of the areas of interest (part of the functional area or construction site) – future situation;
- assessment of compliance of the investment plan with the regulation on functional use of areas with regulation of the functional use of the areas; in the event of a limited share of residential surface (functional area codes 201, 202, and 501), it is necessary to assess the compliance of the whole functional area.
At the same time, we stipulate that the assessment of compliance of the planned construction in the stabilised area with the approved general plan documentation needs to include the whole functional area affected. Calculations of regulations of intensity of use of the area shall be in the form of charts with the necessary information on every construction and the total calculation of regulations of intensity of use in the functional area affected. The intensity of the planned construction in the stabilised area shall be compared with the calculated regulation values.
For purposes of illustration, it is worth preparing a schematic plan of the functional area affected with the individual constructions.
Informational data on amount of green vegetation on the plot of land if it can be calculated based on the built-up area and access to the functional area.
The share of residential surface area and of community facilities shall be calculated based on gross above-ground surface area in the event of limited residential surface share (functional area codes of 201, 202 and 501).
Calculation of indicators of intensity of use of the area shall be executed based on the following definitions in the ÚPN (Section 2.2.1. Intensity of Use of Functional Areas):
- Index of Floor Surface (IPP) describes the share of total surface area of the floors of above-ground buildings to the total surface of the functional area or its part. It represents the maximum value of use of the area in question. The advantage of this indicator is its clarity and the unequivocalness of the criterion and it is easy to use to express other related indicators, criteria and recommendations.
- Index of Built-Up Surface (IZP) defines the share of the total of built-up area of the functional area or its part to the total surface of the area at hand. It depends on the location and importance of the area concerned, the manner of its functional use, and the type of built-up constructions.
- Green Vegetation Coefficient (KZ) defines the share of respective green vegetation surfaces (natural green vegetation, vegetation above underground constructions) and the total surface of the area in question. The regulation stipulates the minimum green vegetation share on the functional area and is related to the function itself. It depends, in particular, on the mode of the functional use and the location of the development area in the city.
The share of the respective green vegetation areas in the area (m²)=KZ x surface of the functional area (m²).
2. as regards the respective zoning plan (ÚPN Z)
If the area has a valid zoning plan (such areas are indicated with the code “S” in the ÚPN), it is necessary to provide data on the plan’s compliance with the general plan documentation under Section 3 (4) (a) of Regulation No. 453/2000 Coll.. The filing shall include the assessment of compliance with all regulations under the mandatory part of the ÚPN Z (for the respective block, sector, regulation unit etc.).
